Four years ago, a man in Kentucky, unconscious and about to be taken off life support for organ donation, unexpectedly began to regain consciousness. Despite his clear reactions—crying, drawing his legs up, and shaking his head—medical personnel proceeded with preparations for organ removal.

A recent federal investigation has revealed that the nonprofit responsible for coordinating organ donations in Kentucky overlooked signs of increasing awareness in not only this individual but also dozens of other potential donors.

The inquiry reviewed approximately 350 cases in Kentucky over the past four years where planned organ removals were ultimately halted. Findings indicate that in 73 of these cases, officials should have reconsidered continuing due to patients displaying elevated or improving consciousness levels.

Although the organ removal procedures were not carried out, the investigation found that multiple patients exhibited indications of pain or distress during preparation for surgery.

While most patients passed away within hours or days, some regained sufficient recovery to be discharged from the hospital, according to the federal Health Resources and Services Administration’s review.

The investigation focused on the growing practice known as “donation after circulatory death.” Unlike traditional donors declared brain-dead, these patients retain some brain function but are maintained on life support and are not expected to recover, often being in a coma.
