On March 27, 2015, the Manhattan district attorney’s office decided not to pursue charges against Harvey Weinstein after Ambra Battilana Gutierrez, a Filipino-Italian model, reported to police that Weinstein had groped her breast and slid his hand up her skirt during a meeting at his Manhattan office. This decision came despite a covert recording in which Weinstein appeared to apologize and seemed to admit to the behavior.
In early October 2017, investigations brought to light multiple allegations of sexual misconduct against Weinstein, alongside reports that his company actively concealed these accusations.
On March 19, 2018, the Governor of New York initiated a review of the 2015 decision not to file charges against Weinstein, questioning the judgment of the district attorney at that time.
By early April 2018, a new prosecutor was assigned to lead the investigation into Weinstein’s conduct.
On May 25, 2018, Weinstein surrendered to authorities following an indictment that included charges of rape and criminal sexual act. The rape allegation involved an incident with aspiring actress Jessica Mann at a Manhattan hotel in 2013. The criminal sexual act charge related to Lucia Evans, a marketing executive who said Weinstein forced her to perform oral sex during a meeting in his office in 2004.
Additional charges were brought on July 2, 2018, concerning allegations that Weinstein compelled oral sex from Miriam Haley, a former production assistant on the television series “Project Runway,” in his Manhattan apartment in July 2006.
On October 11, 2018, a judge dismissed the charge related to the forcible oral sex allegation involving Lucia Evans after prosecutors disclosed that the lead detective had withheld critical information about a witness that cast doubt on her testimony.
